These terms govern your access to and use of the CoverMyClass marketing website at covermyclass.com. Use of the CoverMyClass platform is contracted separately during procurement and is not varied or replaced by anything on this page.

1. Who we are
The website is operated by CoverMyClass Ltd, a company registered in England and Wales. References in these terms to "we", "us", and "our" mean CoverMyClass Ltd. References to "you" mean any individual or organisation accessing the website.

2. Acceptance
By accessing or using the website, you agree to these terms, our Privacy Policy, and our Cookie Policy. If you do not agree, you must stop using the website.
If you are accessing the website on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.
3. The website is not the platform
The CoverMyClass platform — the software product used by schools — is provided under a separate service agreement, which includes a Data Processing Agreement, an acceptable-use policy, and a service-level agreement. Nothing on this website varies, replaces, or qualifies those documents. If there is any conflict between these terms and the platform service agreement, the platform service agreement governs platform use.
4. Permitted use
You may use the website to:
- learn about CoverMyClass and our services;
- request information, request a demonstration, or contact us about a legitimate enquiry; and
- view, print, or download extracts of content for personal, non-commercial reference.
You must not use the website to:
- breach any law, regulation, or third-party right;
- attempt to gain unauthorised access to any system, account, network, or data;
- introduce viruses, trojans, worms, logic bombs, or other malicious code, or otherwise attack the website;
- conduct a denial-of-service, brute-force, vulnerability-probing, or similar attack;
- impersonate any person, or misrepresent your identity or affiliation;
- engage in automated scraping, crawling, harvesting, mass downloading, or bulk extraction of website content, except by a search-engine crawler obeying our published robots directives;
- use the website or any content to train, fine-tune, develop, evaluate, or benchmark any machine-learning model, generative AI system, large language model, or similar system, except with our prior written consent;
- frame, mirror, embed, or republish the website without our prior written consent;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from any part of the website; or
- collect or solicit personal data of other users.
Attempting to access systems, accounts, or data without authorisation may be a criminal offence under the Computer Misuse Act 1990. We may report suspected offences to law enforcement.
5. Intellectual property
The website — including all text, graphics, layouts, copy, design, code, photography, illustrations, branding, trade marks, and trade names — is owned by CoverMyClass Ltd or our licensors. All rights are reserved.
"CoverMyClass" and our logo are unregistered trade marks of CoverMyClass Ltd. You may not use our name, logo, or marks without our prior written consent, except for fair, descriptive purposes consistent with normal commercial usage (for example, referring to us by name in a procurement document).
You receive no licence, by implication or otherwise, to any of our intellectual property except the limited, revocable, non-exclusive permission to view and use the website for the purposes set out in clause 4.
Notice and takedown. If you believe content on the website infringes your copyright, trade mark, or other intellectual-property right, send a notice to hello@covermyclass.com with the subject line "IP infringement notice" including: (a) your full name, address, and contact details (or those of your authorised agent); (b) identification of the right you claim has been infringed; (c) identification of the specific content, with its URL; (d) a statement that you have a good-faith belief that the use is not authorised by the rights-holder, its agent, or the law; and (e) a statement that the information in the notice is accurate. We will review compliant notices promptly and may, at our sole discretion, remove or restrict access to disputed content while we investigate. We may share a notice with the alleged infringer where appropriate. Submission of a knowingly false or abusive notice may give rise to liability.
6. Feedback
If you send us feedback, suggestions, ideas, or proposals about our website or services, you grant us a perpetual, royalty-free, worldwide, irrevocable, sub-licensable licence to use, copy, modify, publish, and otherwise exploit that feedback without restriction or attribution. We do not treat feedback as confidential.
7. Third-party content and links
The website may link to third-party websites, services, or resources we do not control. We provide those links for convenience only. We do not endorse, and are not responsible for, the availability, content, accuracy, security, or practices of any third-party site. Your use of any third-party site is at your own risk and subject to that site's terms.

10. Limitation of liability

Subject to that, and to the fullest extent permitted by law:
- we are not liable to you for any loss of profit, loss of revenue, loss of business, loss of contracts, loss of anticipated savings, loss of goodwill, loss or corruption of data, loss of opportunity, or for any indirect, special, or consequential loss, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise; and
- our total aggregate liability arising out of or in connection with your use of the website, in any twelve-month period, is limited to one hundred pounds sterling (£100).
Our separate liability to school customers in respect of platform use is governed by the platform service agreement, not by this clause.
This clause survives termination of these terms.
11. Indemnity
You agree to indemnify and hold harmless CoverMyClass Ltd and our directors, officers, employees, and agents against any loss, damage, cost, claim, or expense (including reasonable legal fees) arising out of or in connection with:
- your breach of these terms;
- your misuse of the website; or
- your infringement of any third-party right through your use of the website.
12. Suspension and termination
We may suspend or terminate your access to the website at any time, without notice, if we reasonably believe you have breached these terms or applicable law. On termination, all rights granted to you under these terms cease immediately. Clauses 4, 5, 6, 9, 10, 11, 13, 14, and 15 survive termination.
13. Changes to these terms
We may update these terms from time to time. The current version is always available on this page with the version number and effective date shown at the top. Your continued use of the website after a change takes effect constitutes acceptance of the updated terms.
14. General
- Entire agreement. These terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us in relation to use of the website. They replace any prior agreement.
- No waiver. Any delay or failure by us to enforce any right under these terms is not a waiver of that right.
- Severability. If any provision of these terms is found invalid or unenforceable, the rest will continue in full force.
- Assignment. You may not assign or transfer your rights under these terms. We may assign or transfer ours.
- No partnership. Nothing in these terms creates a partnership, agency, employment, or fiduciary relationship.
- Force majeure. We are not liable for any failure or delay caused by events outside our reasonable control, including network outages, third-party service failure, industrial action, or acts of public authority.
- Notices. Notices to us must be sent to hello@covermyclass.com. Notices to you may be given by posting on the website.
- Third-party rights. A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them.
15. Governing law and jurisdiction
These terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of England and Wales. You and we agree to submit to the exclusive jurisdiction of the courts of England and Wales.
